Your lessons and courses are operated by JB Kitesurfing Ltd (“the Company”) which is registered in England under company number 06719441. The following conditions together with the information set out in our website will form part of your contract with the Company.

1. Booking your course: To join one of our Kitesurfing, Power kiting, or Kite buggy courses or lessons we would expect all persons to be able bodied, where water based to be able to swim at least 50 meters in the sea and for all students to notify us of any medical condition so that we can assess individual needs.
Should you not inform us as above especially of any medical or physical condition we cannot be held in any way responsible / liable for injury, side effect both physical and mental as sustained from attending any type of course or lesson delivered by JB Kitesurfing, associated instructors and employee’s?
2. Payments – For course booked greater than 10 days prior to the start date the company should receive a non-returnable deposit of £75.00
2.1 For course booked less than 10 days to the start date full payment will be required.
2.2 Balance should be paid at least 7 days prior to your course date or by special arrangement to pay on the day with our new mobile payment solution.
3. Vouchers
3.1Vouchers are valid for one year from the purchase date at which point it will assumed to be forfeited.
3.2 – Your voucher can only be redeemed against a JB Kitesurfing lesson or course and is not part or cash refundable.
4. Cancellation by you; should you need to cancel your booking then the following terms apply.
4..1 Greater than 14 days prior to your course date – loss of deposit – £75.00
4.2 7 to 4 days prior to your course date – 50% loss of the total value of your booking
4.3 Less than 4 days – 100% loss.
4.4 To cancel your booking we must receive an email and verbal confirmation.
5. Refunds
5.1 Cash refunds are not possible in any circumstance.
5.2 All refunds are made by voucher to the value as due to be redeemed (see section 3) within 1 year of issue. Refund vouchers will be issued once we have received a verbal and email confirmation.
6 – Cancellation by us; We are dependent on wind and tide condition so whilst we are happy to travel to a Kitesurfing beach where we can teach you there is the odd occasion where we can’t teach due to unforeseen circumstances.
6.1 We reserve the right to reschedule your lesson to the next possible lesson date. Should re scheduling not be possible then a lesson voucher can be issued (see section 4). We would expect students to confirm this date within 5 days of notification as otherwise we would consider it reasonable that you are forfeiting your course and cancellation will apply see section 4 This is purely to encourage students to actively pursue and achieve their Kitesurfing goals.
7 – Re Scheduling by us; Wind is fickle and whilst tides are predictable we risk assess our local Kitesurfing beach so that should conditions be too strong or too little we reserve the right to reschedule your course to the next and nearest available date.
7.1 – Whilst we will make every effort to accommodate a preferred date we do expect students to make every effort to be as flexible as possible with us.
7.2 – Should we offer you more than 3 other possible dates to complete your lessons, we deem it only fare to cancel in full with NO refund if you do not re schedule to those dates. This is not a situation that we want, it is purely to encourage students to actively pursue and achieve their Kitesurfing goals
7.3 – JB Kitesurfing is a mobile school in Sussex and Cornwall. In Sussex we operate at Lancing with winds from the South East through to South West. When from the North to North Easterly we travel to Greatstone in Kent. We will give as much notice as we can but as you know wind can change overnight. JB Kitesurfing reserves the right to change location at short notice to either Lancing or Greatstone to suit the days wind direction. Cancellation terms apply see section 4.
7.4 – In Cornwall we operate at Gwithian beach so with winds from the South West through to North West. We have the perfect wind direction. From South east to South, South West we travel to Long rock in Penzance. We will give as much notice as we can but as you know wind can change overnight. JB Kitesurfing reserves the right to change location at short to suit the days wind direction. Cancellation terms apply see section 4.
8 – Re Scheduling by you – If you provide sufficient notice as per our cancellation terms above we will reschedule to a date convenient to you.
8.1 – Less than 7 days’ notice – Loss of deposit with course rescheduled. (If not rescheduled then Terms and conditions apply see section 4)
9. Change in group size
Whilst we endeavor to make sure that your group lesson is fully booked should there be a reduction in students we reserve the right to change and amend your lesson duration to as follows.
9.1 – Should your group lesson have 3 students booked in there is no change.
9.2 – Should your group lesson only have 2 students booked in we reserve the right to reduce your course duration to 4 hours from a 5 hour course.
9.3 – Should your lesson be only you so 1 student booked in then we reserve the right to offer you the upgrade to a private 4 hour lesson with the additional cost of £35.00 or to reschedule your course to the next available date.
10. Activity and Travel insurance
Whilst we have a full school insurance that covers you for 3rd party only whilst under our instruction, it is vital that you have an insurance that covers you personally in the event of injury when power kiting, kite Buggying or Kitesurfing plus any other activities that you participate in.

10.1 – If you are joining us on a Kitesurfing holiday abroad it is vital that you have travel insurance that covers you in the event of flight cancellation (loss of deposit and any further cancellation fees), Kitesurfing plus any other activities that you wish to participate in. If you have insurance already we advise that you check with your insurers to make sure it is sufficient. If you do not have insurance in place at the time of booking we recommend that you arrange this as soon as possible as covers you pre-holiday.
10.1 No Insurance Declaration
JB Kitesurfing Ltd has no liability to you in respect of your failure to obtain suitable insurance cover. Please note you are not covered for cancellation due to illness etc. if you do not have insurance in place.

11. Release of Liability, Waiver of Legal Rights and Assumption of Risk
In consideration for the usage, renting, purchasing, of kite boarding equipment from and /or utilizing of the facilities, ground school, instruction, premises, and equipment of JB Kitesurfing Ltd in engaging in the sport of Power kiting, Kite Buggying, Kite boarding also known as Kitesurfing, ground instruction, water instruction, I hereby understand and agree to this release of liability, waive of legal rights, and assumption of risk, and to the Terms hereof as follows:

11.1). I acknowledge that Kitesurfing is an action sport and recreational activity involving travel in three dimensions and such activity is subject to mishap and even injury to participating in the sport of Kitesurfing.
11.2). I understand that if instructor advice is not correctly followed during a Power kiting, Kitesurfing, Kite boarding and Kite Buggying lesson (hereinafter collectively referred to as “JB sports”) JB Kitesurfing cannot be held responsible for any injuries sustained. I also acknowledge that “JB Sports” have inherent dangers that no amount of care, caution, instruction, or expertise can totally eliminate.
11.3). I hereby release discharge to JB Kitesurfing Ltd and their officers, directors, elected officials, agents, employees, instructors, and owners of equipment and the land used for kite boarding / Kitesurfing activities (hereinafter collectively referred to as “Released Parties”), from any and all liability, claims, demands, or causes of action that I may hereafter have for injuries, disability, or death, or damages arising out of my participation in these activities, including, but not limited to, losses caused by the negligence of released parties.
11.4). I further agree that I will not sue or make a claim against the Released Parties for damages or other losses sustained as a result of my participation in JB Sports activities.
11.5). I also agree to indemnify and hold the released parties harmless from all claims, judgments, and costs, including attorneys’ fees, incurred in connection with any action brought as a result of my participation in “JB Sports” activities.
11.6). I will take full responsibility for, and hold harmless Released Parties for any injury that I may suffer or inflict upon others or their property as a result of my engaging in “JB Sports” activities.
11.7). I agree that I will operate the said “JB Sports” equipment in a reasonable and safe manner so as not to endanger the lives of persons or property of any individual.
11.8). I have read and understand the above and acknowledge that the same constitutes a release of liability and a waiver of my legal rights and also acknowledgment of the assumption by me of all risks arising out of my engaging in “JB Sports” activities. I further represent that this release of liability, waiver of legal rights and assumption of risk shall continue in full force and effect for so long as I engage in “JB Sports” activities which are in any way connected to or with the Released Parties.
11.10). I further represent that I am at least 18 years of age or that as the parent or legal guardian I waive and release any and all legal rights that may accrue to me or to my minor child as the result of any injury that my son or daughter(minor) may suffer while engaging in JB Sports activities.
11.11). I hereby expressly recognize that this Release of Liability, Waiver of Legal Rights and Assumption of Risk is a contract pursuant to which I have released any and all claims against the Released Parties resulting from my participation in “JB Sports” activities including any claims by the negligence of the Released Parties.
